Gift and non-arm’s length transfer appraisals in Toronto and the GTA

When you sell or gift a property to a family member or another non-arm’s length party, the CRA can treat the transaction as happening at fair market value, even if the price paid was lower. An appraisal documents that value.

How it works

A supportable value helps avoid disputes about the proceeds of disposition and the buyer’s cost. Your accountant or lawyer can advise how the rules apply to your transfer.

Common questions

What is a non-arm’s length transfer?

A transfer between related people, such as family members, or between parties who are not dealing independently, such as a person and a corporation they control.

Why does the value matter if no money changes hands?

The CRA can treat a gift as a sale at fair market value, which can produce a capital gain for the person who gave the property.
